Don’t you EVER tell me “it’s for the children” again.  You don’t care about children.

And don’t tell me about “we need to be thorough in our courts, so that no innocent accused is wrongly punished”.

Don’t brag about our “civilized justice system”, or whine about “cruel and unusual punishment”.

If there was EVER a case of clear cut, no questions asked guilt, or a “defendant” so obviously evil, I don’t know about it.

And he is in court right now, playing you all for fools, and raping again, not just a 9 year old boy and his sister, but the entire concept of justice.

A bullet in the forehead is the only answer here, but no one has the stones to quit playing the ridiculous lawyer game.  I’m afraid for this country when I see things like this.  Isn’t anyone paying attention to what happened here?  Tiptoeing around this piece of filth, being ever so careful of his rights…

you lawyers and judges disgust me.  You should be ashamed.

(and before anyone tries to calm me down by telling me this is the sentencing phase of a death penalty case, allow me to tell you to “bite it” because this case will drag on in appeals for 15 or 20 years, and a hundred lawyers and their spawn will be richly paid beyond your and my wildest dreams, while this guy gets three squares a day, all the medical and press attention he can stand, courtesy of you and me, thank you Mr and Mrs Taxpayer.  And there is a father out there tonight who lost his family in a horrific way; and a little girl who watched her brother abused and killed; and a group of people who sat as a jury today, who will have nightmares for the rest of their lives, after being forced to watch the damned killer’s video.  No one protected any of them, and no one was punished.  But we can all pat ourselves on the back, for taking such good care of Joseph Duncan’s rights… {spit}… proud of yourself? )

However, the drunken loser with the fake handgun should be thankful he isn’t in a pine box this morning.

Witnesses told police the trouble started when a car passed Smith’s truck as both vehicles were on the way up to the top of Table Rock.

Witnesses said when Smith got to the top of the mesa, by the giant fluorescent cross which overlooks the city, he got out of his truck and pulled out a handgun, first threatening the driver of the other car, and then pointing it at other people on top of the mesa and threatening them.

At that point, witnesses said the driver of the car Smith first threatened pulled out a 9 mm handgun, pointed it at Smith, and told him he was going to disarm him. That man then took the handgun from Smith and determined it was fake.

I hate to be second guessing the man with the real gun who was actually there, and it isn’t likely I’ll ever be in that remote a place at midnight, but if someone drew on me and threatened other people in the remote dark of night, I’m not sure that telling the guy I was going to disarm him is the first thing I would do.   I suspect there are other details to this story that aren’t in the newspaper report.  I think I’d be more inclined to stop the threat by force of my own, than by talking the other guy out of it.  It worked this time.  But here is the mental exercise for all of us… how could this have been different if the drunk had a REAL handgun?   Gambling on the other guy’s gun being a fake doesn’t seem like a high percentage bet to me.  When your life is at stake, take the sure bet.
